1. Agreement & Acceptance of Terms

Welcome to Vivex Network ("App", "Platform", "Service", "we", "us", or "our"). These Terms of Service ("Terms" or "Terms & Conditions") govern your access to and use of the Vivex Network mobile application (Package Name: com.vivexnetwork), backend cloud infrastructure, official website, and related digital services.

By downloading, installing, registering an account on, accessing, or using Vivex Network, you enter into a legally binding contract with us and agree to comply strictly with these Terms, as well as our Privacy Policy.

2. User Eligibility & Account Registration

A. Strict Age Requirement (18+ Only)

You must be at least 18 years of age to register an account, participate in cloud mining, or use any features of Vivex Network. Minors under 18 years of age are strictly prohibited from using the Service. By registering an account, you represent and warrant that you are 18 years of age or older.

B. Single Account Ownership Policy

Each individual user is permitted to create and operate only one (1) account across the entire Vivex Network platform. Accounts are strictly non-transferable and tied exclusively to the individual creator.

C. Account Registration via Google Sign-In

To use Vivex Network, you must authenticate using a valid Google Account via Google Sign-In and Google Credential Manager. You agree to:

• Provide accurate, complete, and truthful account profile information (including Username, Real Name, and Country).
• Maintain only one active Google Account connection to your Vivex Network profile.
• Refrain from using temporary, disposable, or automated bot email accounts.

D. Account Responsibility & Security

You are solely responsible for maintaining the confidentiality of your Google authentication credentials and for all activities, mining activations, transactions, or actions performed under your account. Vivex Network shall not be held liable for any loss or damage arising from unauthorized account access resulting from your failure to secure your device or credentials.

3. Nature of Cloud Mining & Virtual Utility Tokens (DISCLAIMERS)

3.1 Educational & Simulated Cloud Mining

"Mining" within Vivex Network refers to a virtual, cloud-based token distribution protocol. It does NOT utilize your mobile device's local CPU, GPU, memory, or battery hardware to perform cryptographic Proof-of-Work (PoW) computation. All token allocations are calculated server-side based on active cloud sessions, streak multipliers, and referral network trees.

3.2 Virtual Utility Token Status

All tokens, coins, counters, points, or balances accumulated within Vivex Network (collectively, "Vivex Tokens" or "Virtual Tokens", symbol $VVX) represent in-app virtual utility items within our ecosystem.

• Virtual Tokens do NOT constitute legal tender, fiat currency, central bank digital currency (CBDC), financial instruments, stocks, bonds, securities, or financial investments under any legal jurisdiction.
• Virtual Tokens do NOT confer any equity ownership, dividend rights, voting governance rights, or legal claim to corporate assets of Vivex Network or its operators.

3.3 No Guarantee of Future Monetary Value

Vivex Network makes NO representation, warranty, or guarantee that Virtual Tokens will ever achieve monetary value, be listed on cryptocurrency exchanges, or be redeemable for fiat currency or other digital assets. Any prospective token listing, exchange liquidity, or trading milestone mentioned in community roadmaps or promotional materials represents an educational operational goal, not a guaranteed financial outcome.

3.4 Phased Strategic Roadmap, Solana Address Binding & Mandatory KYC

In accordance with our official Strategic Network Roadmap:

• Phase 3 (Solana Address Binding & Pioneer Verification): Users will bind their native Solana (SPL) wallet address in-app for future token distribution. Vivex Network will cover 100% of transfer gas fees.
• Phase 4 (TGE, Pre-Listing Transfer & 100% Unmined Supply Burn): Upon reaching 500,000 active miners, 100% of remaining unmined $VVX tokens will be permanently burned, followed by Token Generation Event (TGE) distribution and exchange trading activation.
• Mandatory Pioneer Identity Verification (KYC): To prevent sybil attacks, bot referral farms, and multi-accounting, users must undergo Know Your Customer (KYC) verification (submitting valid Government ID, facial selfie/liveness check, and legal name) before pre-listing token transfers are executed.
• IMMEDIATE RAW KYC DATA DELETION GUARANTEE: To ensure maximum privacy and zero risk of identity leaks, all raw identity document scans (CNIC / Passport / Driver's License) and selfie images are IMMEDIATELY AND PERMANENTLY PURGED / DELETED from active storage as soon as verification validation is finalized. Only an encrypted verification status (kyc_verified = true) secured by Supabase AES-256 encryption and Row-Level Security (RLS) is retained.
• Forfeiture of Unverified / Fake Balances: Accounts that fail KYC, engage in identity fraud, or fail to complete verification prior to TGE deadlines will have their unverified balances permanently forfeited and burned.

3.5 Network Tokenomics & Supply Adjustments

To maintain economic sustainability, prevent inflation, and protect ecosystem integrity, Vivex Network reserves the absolute right, at its sole discretion, to:

• Adjust base cloud mining rates, halving schedules, daily check-in bonuses, and referral multiplier rates.
• Modify maximum supply limits, burn schedules, or streak bonus calculations without prior individual notice.

4. Strict Zero-Tolerance Fair Play, Anti-Cheat & Anti-Fraud Policy

To protect the fairness of the network for our legitimate global community, Vivex Network enforces a Strict Zero-Tolerance Anti-Cheat and Anti-Fraud Policy.

4.1 Forbidden Fraudulent Practices

You agree that you will NOT, under any circumstances, directly or indirectly engage in any of the following prohibited activities:

1. Underage Usage: Registering or operating an account if you are under 18 years of age.
2. Multi-Accounting: Creating, maintaining, or operating more than one (1) Vivex Network account, or logging into multiple accounts on a single physical mobile device.
3. Emulators & Virtual Spaces: Running the Vivex Network APK within Android emulators (e.g., BlueStacks, Nox, LDPlayer, MEmu), virtual machines (VMOS), parallel space apps, app cloners, or dual-app engines.
4. Automated Scripts & Exploits: Using auto-clickers, macro software, bot scripts, memory editors, packet sniffers, reverse-engineering tools, or modified/tampered APK binaries.
5. Hardware & OS Bypasses: Modifying device signatures, spoofing ANDROID_ID values, masking system root status, or attempting to bypass security checks implemented by RootChecker.
6. Network & Location Spoofing: Utilizing Virtual Private Networks (VPNs), proxies, TOR nodes, or location-spoofing tools to artificially bypass country restrictions or manipulate referral rewards.
7. Referral Fraud: Creating fake referral accounts, self-referring via secondary devices/emails, purchasing bot referrals, or operating automated referral farms.
8. Task Falsification: Exploiting, bypassing, or falsifying completion logs for daily check-in tasks, rewarded video ads, or social quests.

4.2 Security Auditing & Hardware Fingerprinting

Vivex Network actively employs automated backend security algorithms, Supabase database security controls (AES-256 & RLS), device fingerprinting, install referrer checks, and integrity audits to detect sybil attacks, bot patterns, and fraud attempts.

4.3 Penalties & Enforcement Measures

If Vivex Network determines, in its sole discretion, that an account has violated any provision of this Anti-Cheat Policy, we reserve the right to immediately take any or all of the following actions without prior warning, notice, or right of appeal:

• Permanent Account Suspension: Immediate termination of access to the Vivex Network app and backend services.
• Hardware Blacklisting: Permanent blacklisting of the user's Device ID (ANDROID_ID), IP range, and hardware fingerprints.
• Total Token Forfeiture: Complete erasure, forfeiture, and permanent burning of all accumulated virtual balances, mining rewards, streak bonuses, and referral earnings.
• Legal Action: Pursuing civil or criminal remedies for financial loss or platform disruption caused by malicious attacks.

5. Referral Program & Social Task Rules

1. Legitimate Referrals Only: Referral bonuses are awarded only when an invited user (18+ years old) creates a genuine account, provides a unique Device ID, and actively participates in mining sessions.
2. Audit Rights: We reserve the right to audit all referral networks. If an account's referral tree contains fraudulent, inactive, or bot accounts, all associated referral bonuses will be revoked and deducted from the inviter's balance.
3. No Commercial Spam: You may not spam referral codes in prohibited public forums, app reviews, or via automated messaging platforms.

6. Intellectual Property Rights & Limited License

A. Ownership

All rights, titles, and interests in and to Vivex Network, including but not limited to the mobile application, source code, visual UI/UX designs, animations, logos, graphics, brand name, trademarks, documentation, and cloud architecture, are the sole and exclusive intellectual property of Vivex Network and its creators.

B. Limited License Grant

Subject to your strict compliance with these Terms, Vivex Network grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the mobile application on your personal mobile device solely for personal, non-commercial use.

C. Restrictions

You shall not:

• Copy, modify, decompile, reverse-engineer, disassemble, or extract source code from the App.
• Frame, mirror, rent, lease, sell, sublicense, or distribute any part of the App or brand assets without explicit written permission.

7. Public Leaderboards & Community Guidelines

A. Public Leaderboard Consent

By using Vivex Network, you grant us permission to display your Username, Country of Residence, Global Mining Rank, and Total Virtual Balance on public Leaderboard screens (RankScreen) to foster competitive community gameplay.

B. Community Conduct Standards

When choosing a Username, uploading a profile avatar, or interacting with the Vivex Network community, you must not use content that is:

• Defamatory, obscene, profane, pornographic, or sexually explicit.
• Hateful, harassing, discriminatory, or promoting violence based on race, religion, nationality, or gender.
• Fraudulent, deceptive, impersonating another person or entity, or infringing upon third-party intellectual property rights.

We reserve the right to forcibly change offensive usernames, remove inappropriate profile pictures, or terminate accounts violating community standards.

8. Third-Party Links, Ads & Services

1. Third-Party Advertisements: Vivex Network may display third-party advertisements served via Google AdMob or other ad networks. We do not control, endorse, or assume responsibility for the content, privacy practices, or products offered by third-party advertisers.
2. External Web Links: The App may contain links to third-party websites (e.g., social media channels, news outlets). Accessing external links is entirely at your own risk.

9. Service Availability, Maintenance & Warranty Disclaimers

A. Service Provided "AS IS" & "AS AVAILABLE"

B. System Maintenance & Outages

We do not warrant that:

• The App will operate uninterrupted, error-free, bug-free, or without temporary downtime.
• Server synchronization delays, cloud backend maintenance (e.g., Supabase updates), or network interruptions will not occur.
• Data transmissions will be entirely immune to third-party cyber-attacks or hardware failures.

C. Right to Modify or Discontinue

Vivex Network reserves the absolute right to modify, update, suspend, interrupt, or permanently discontinue the Service (or any feature, mining rate, or token allocation) at any time, with or without notice, without liability to you or any third party.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VIVEX NETWORK, ITS DEVELOPERS, OPERATORS, AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
• LOSS OF VIRTUAL TOKENS, ACCUMULATED BALANCES, OR MINING REWARDS;
• LOSS OF DATA, GOODWILL, REPUTATION, OR PROFIT;
• DEVICE DAMAGE, SYSTEM MALFUNCTION, OR HARDWARE FAILURE;
• UNAUTHORIZED ACCOUNT ACCESS OR THIRD-PARTY CYBER-ATTACKS;

ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE VIVEX NETWORK APPLICATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED ZERO US DOLLARS ($0.00 USD).

11. Indemnification

You agree to defend, indemnify, and hold harmless Vivex Network, its developers, operators, hosting partners, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including attorney's fees) arising from:

• Your access to and use of the App;
• Your violation of any provision of these Terms or the Privacy Policy;
• Your breach of our Anti-Cheat and Fair Play Policy;
• Your violation of any third-party right, including intellectual property or privacy rights.

12. Account Termination & Suspension

A. Direct Instant Account Deletion by You

You may terminate your agreement to these Terms and permanently delete your account at any time directly within the Vivex Network Android application:

1. Go to Settings (SettingsScreen).
2. Select Delete Account -> Confirm Delete.

Upon confirmation, your user profile, Google authentication bindings, mining balance, streak logs, uploaded avatars, and referral connections are immediately and permanently wiped from Supabase cloud database servers without requiring email requests or manual approval waiting periods. Alternatively, if you cannot access your device, you may email [email protected] to request manual account deletion.

B. Termination by Us

We reserve the right, without notice and at our sole discretion, to terminate or suspend your account, blacklist your device, and block your access to the App for any reason, including but not limited to:

• Breach of these Terms or Anti-Cheat policies;
• Suspected fraudulent, automated, or illegal activity;
• Extended account inactivity (12+ consecutive months);
• Platform sunsetting or operational discontinuation.

13. Governing Law, Dispute Resolution & Class Action Waiver

A. Governing Law

These Terms shall be governed by and construed in accordance with the laws of applicable jurisdiction, without giving effect to any principles of conflicts of law.

B. Informal Dispute Resolution

Before filing a formal legal claim, you agree to attempt to resolve any dispute informally by contacting our legal team at [email protected]. We will attempt to resolve the dispute informally within thirty (30) days.

C. Class Action Waiver

14. Modifications to Terms of Service

We reserve the right to revise, update, or modify these Terms at any time.

• Notification: Updated Terms will be published within the App or on our official website with a revised "Last Updated" date.
• Acceptance: Your continued installation, access, or use of Vivex Network following the posting of updated Terms constitutes your binding acceptance of such modifications.
